Admissibility of a complaint
Before opening a case, the originating SOLVIT Centre must check that the 4 cumulative criteria for admissibility of the complaint are met:
- Cross-border criterion - a problem an applicant in one Member State encounters involving a potential breach of EU law governing the internal market by a public authority in another Member State; this includes problems caused to applicants by their own public administrations, after having exercised their free movement rights or when trying to do so;
- A public authority does not respect Union law governing the internal market;
- A public administration or a private entity with public authority is involved;
- The problem is not subject to legal proceedings at neither national nor EU level.
SOLVIT does not deal with problems between businesses, cases concerning your rights as a consumer or claims for compensation in the event of damage.
